This page outlines the Terms of Use of the FlowLogic website as well as the FlowLogic mobile application (FlowLogic App). The FlowLogic website and FlowLogic App are referred to collectively as the FlowLogic products, and each of them is a FlowLogic product.

These Terms of Use, as well as FlowLogic’s Privacy Policy, apply to your use of the FlowLogic products. By continuing to browse, access and/or use the FlowLogic products, you agree to comply with these Terms of Use and FlowLogic’s Privacy Policy (collectively, the Agreement).  

If you disagree with any term of the Agreement, you must not browse, access and/or use the FlowLogic website and should uninstall the FlowLogic App from your device(s).

1. Use of the FlowLogic products

• You must only use the FlowLogic products for their intended purpose. You must use the FlowLogic products for lawful purposes only.
• You must not use the FlowLogic products:
  • in any way that violates any applicable law or regulation;
  • to collect, use or disclose personal or sensitive information unlawfully;
  • to knowingly transmit any viruses, worms or other harmful code;
  • in any way that would impede the security of the FlowLogic products or their related systems; or
  • to attempt to gain unauthorised access to any part of the FlowLogic products or their related systems.
• You understand and agree that any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities.
• FlowLogic does not guarantee continuous, uninterrupted, or secure access and/or use of the FlowLogic products.
• FlowLogic may, acting reasonably, suspend your access to the FlowLogic products in whole or in part at any time without notice or compensation where it is in FlowLogic’s legitimate business interests to do so.
• FlowLogic’s provision of the FlowLogic products may also be suspended to the extent caused by any event beyond FlowLogic’s reasonable control (including, but not limited to, natural disaster, communication network failure and/or congestion, riot or war).
• From time to time, the FlowLogic App may be available for download via online stores for purchasing and downloading software and applications for mobile phones and other devices, such as Apple or Google App Store (App Store). Your download and access of the FlowLogic App is subject to the terms of each App Store and you are solely responsible for complying with those terms.
• Subject to any separate agreement, neither FlowLogic nor any App Store provider is under any obligation to provide technical support to you in relation to the download and installation of the FlowLogic App on your device(s).
• You are responsible for ensuring that the device(s) on which the FlowLogic App is installed is in good, up to date working order and operating condition. FlowLogic is not responsible for any inability to access the FlowLogic App or make use of FlowLogic’s services due to issues with your device(s).
• You are responsible for downloading available updates to the FlowLogic App published on App Stores from time to time. FlowLogic is not responsible for any loss you suffer to the extent such loss is caused by your failure to download updates to the FlowLogic App.

2. Intellectual property

• The FlowLogic products contain material that is owned by, or licensed to, FlowLogic. This material includes, but is not limited to, all text, images, graphics, logos, appearance, layout and software. You acknowledge that the Agreement does not licence or transfer any intellectual property rights in FlowLogic, the FlowLogic website or the FlowLogic App or any of their contents to you.
• You must not reproduce, distribute, modify, display, perform or otherwise use any of the content from the FlowLogic products without the prior written consent of FlowLogic.

3. Third party links

• The FlowLogic products may contain links to third party websites or applications. These links are provided for your convenience only. If you leave a FlowLogic product via a third party link, you do so at your own risk. FlowLogic has no control over, and is not responsible for, the content or practices of any third party websites or App Store providers. Your use of third party websites or applications is subject to their separate terms and conditions and you should make your own enquiries before using and/or accessing third party websites or applications.
• FlowLogic does not represent that it has any relationship with any linked website or application nor does FlowLogic endorse the goods, or third party content appearing on or via a third party link.

4. Disclaimers

• The content on the FlowLogic products is provided for general information purposes only. While FlowLogic makes reasonable efforts to ensure its accuracy, FlowLogic makes no representation or warranty of any kind regarding the accuracy or completeness of the information contained on the FlowLogic products.
• To the maximum extent permitted by law, FlowLogic excludes all warranties, representations or guarantees regarding the FlowLogic products or their content, including by reason of negligence for, errors in, or omissions from, information on the FlowLogic website or the FlowLogic App, and FlowLogic does not accept any liability for any loss or damage, howsoever caused, as a result of any person relying on any information on the FlowLogic website or the FlowLogic App.

5. Limitation of liability and indemnity

• To the maximum extent permitted by law, FlowLogic is not liable for any loss, damage or expense (including indirect or consequential loss) arising from your use of, or reliance on, the FlowLogic products or their content.
• Unauthorised use of the FlowLogic products may give rise to a claim for damages and/or be a criminal offence. You agree to indemnify FlowLogic and hold it, FlowLogic’s officers, directors and employees harmless from any loss, claim or legal liability (including legal fees) arising out of your breach of the Agreement or your breach of any law or the rights of a third party relating to your use of the FlowLogic products.

6. Changes to the Agreement

• FlowLogic may, in its sole discretion, update or amend the Agreement from time to time without notice. Any changes will take effect immediately when published on this page. Your continued use of the FlowLogic products indicates your acceptance of the updated or amended Agreement.

7. Governing law

• The Agreement, and your use of the FlowLogic products, is governed by the laws of Queensland.
